En Banc Federal Circuit Case: LKQ v. GM, Design Patent Obviousness – Rob Katz Joins IPLAC Panel

Rob Katz will participate in a webinar panel for the Intellectual Property Law Association of Chicago (IPLAC) discussing the en banc Federal Circuit appeal in LKQ Corp. v. GM Global Tech.  The panel will be on Thursday, December 7, from noon to 1:30 pm CT. 

It is uncommon for the Federal Circuit to take a case en banc and even rarer for the court to do so for a design patent case. The panelists, all authors of amicus briefs in the case, will delve into the issues central to the case and explore potential outcomes. The central issue in the case is what should be the test for determining obviousness under 35 U.S.C. 103 in the context of design patents.  Rob Katz co-authored the amicus brief for the Industrial Designer’s Society of America along with Erik Maurer, Sonia Okolie, and Joe McCollum.
